Wains Solicitors Macclesfield and Congleton

Family Law covers all sorts of issues connected with the breakdown of personal relationships such as divorce, childcare and ancillary relief.

Divorce

Problems with family can be stressful and can have serious financial implications. At such a difficult time you need the support of a friendly and understanding legal team to help you make the right decisions. We can advise you whether your circumstances would give cause to commence divorce proceedings and also assist you with preparing the necessary documentation to legally dissolve a marriage, including childcare agreements and financial settlements.

Wains will deal with matters in a sensitive and conciliatory manner but recognise the need for tough and speedy action in certain circumstances, where for example the safety of a child or the protection of people or property is involved.

Childcare

Wains have partners who are members of the Family Law Panel and the Children’s Panel and believe that the wellbeing of children is vitally important during family disputes.

The legalities of childcare require specialist knowledge and experience and it is important that you are given the right advice in order to safeguard your child's welfare. In child care proceedings, where the Local Authority considers it necessary to take action to protect a child from “significant harm”, which may involve removing the child from home, Wains can represent the parent or other adults, as well as the child, enabling decisions of the Local Authority about the children to be challenged effectively.

Wains can also assist in obtaining residence or contact with your children and assist in matters where maintenance is payable.

Ancillary Relief

During or after a divorce or judicial separation, there may still be a need to settle disputes over money or property. The court can make a financial order which is referred to as ancillary relief which can help deal with financial settlements of matrimonial assets. i.e. transfer of a property or maintenance payments.

At Wains we have an expert team who can advise and help you face this difficult process and assist in achieving your financial requirements.
