Probate and Administration of Estates

If you are appointed as an Executor under a Will or are acting as an Administrator (if the deceased did not leave a will) we can help you in the following ways:

Grant only service

We can obtain the Grant of Representation for you thus enabling you to go ahead with the collection and distribution of the assets in the estate. 

Our fees would be as follows:
Grant Only for Excepted Estate, £1250.00 plus VAT and disbursements.
Grant Only for Non-Excepted Estate, £1800 - £2250 plus VAT and disbursements*
*Determined by the number and type of IHT Schedules Required

Administration of Estates service

In addition to obtaining the Grant, we can undertake the collection and distribution of the assets and preparation of Estate Accounts.
Wains charge a fixed fee of 1.75% of gross value of the Estate plus VAT and disbursements if you are appointed as an Executor or Administrator.**

If Wains are appointed as Executors in a Will, we charge a fixed fee of 2% of gross value of the Estate plus VAT and disbursements.***

The Administration of Estates service includes the following (as a minimum):

  • Providing you with a dedicated and experienced probate solicitor to work on your matter.
  • Identifying the executors or administrators and beneficiaries.
  • Obtaining a valuation of the assets and assessing debts/liabilities of the estate.
  • Dealing with HMRC and advising you if Inheritance Tax is due to be paid from the estate.
  • Completing the appropriate application for the Grant of Representation and dealing with the HMRC formalities.
  • Collecting and distributing the assets in the estate to the beneficiaries and settling all debts and liabilities.

The following are not included as standard as part of the Administration of Estate service but may be available at an additional cost:

  • Advising and Drafting a Deed of Variation.
  • Advising on claims that may be brought against the estate.
  • Conveyancing Charges for selling or transferring a property or addressing issues with the title of the property.
  • Inspecting or attending at the property in connection with valuations of property / contents or distribution / disposal of contents.
  • Dealing with International Assets (Properties, Shares, Bank Accounts etc).
  • Completion of a Deed in connection with any Trusts under the Will / Intestacy.
  • Contentious Probate and Disputes between Executors.

Nicola Qualified as a Solicitor in 2003 and joined Wains in 2014 as Head of the Probate department, later becoming a Designated Member representing clients in both Macclesfield and Congleton.

Roger qualified as a Solicitor in 1974, going on to open our Congleton Office in 1978 and continues to represent clients in both Macclesfield and Congleton.
